General Terms and Conditions (GTC) for @backtooutdoor
1. personal requirements
Each participant warrants that they have the necessary mental and physical abilities for the booked outdoor tour or coaching. The details of the required abilities will be specified in advance in the offer or the tour description. Participants who are impaired by alcohol, drugs or medication are excluded from participation.
2. safety and risk
Participation in @backtooutdoor outdoor tours is at your own risk. The tours are adventure activities where no comprehensive safety can be guaranteed as with package tours. Our tours are led by qualified and experienced guides and the equipment meets the latest safety standards. Nevertheless, the risks associated with nature adventures cannot be completely excluded.
The liability of the provider, its guides and vicarious agents is limited to gross negligence and intent. The provider is not liable for damages that occur outside the booked activity or result from voluntary activities. Necessary rescue costs (e.g. by rescue services) are to be borne by the participant, unless they are covered by the provider’s liability insurance.
3. termination of the tour and exclusion of participants
The tour leader has the right to exclude participants from the tour who do not fulfill the necessary requirements for the tour or who disregard the safety regulations. In such cases, the participation fee will not be refunded. The tour leader may change or cancel the tour program due to safety concerns, such as weather changes or insufficient skills of the participants. In such cases there is also no entitlement to a refund.
4 Tour duration
The tour durations stated in the program or on the website are for guidance only. Deviations may occur due to unforeseeable factors such as weather or participant abilities.
5. liability
Arrival: The arrival and departure to the tour areas is partly in private vehicles, which are not part of our offer. The provider accepts no liability for accidents or damage that occur on arrival or departure.
Equipment: Borrowed equipment must be properly returned by the participant. The borrower is liable for any damage or loss to the equipment.
Health: The tours and coaching sessions offered place increased demands on the fitness and health of the participants. Participation is at the participant’s own risk. The instructions of the guides must be followed at all times.
6. special conditions for canyoning and rafting tours
Rafting:
Every participant must have sufficient swimming skills in flowing water. The helmet and life jacket must be worn properly during the entire tour. The participant is liable for willful damage to boats or equipment.
Canyoning:
Canyoning often takes place in pathless, slippery terrain. Every participant is required to act prudently and carefully. Only secured and supervised areas may be entered. The instructions of the canyoning guide must be followed at all times, especially when jumping or handling equipment.
7 Photos and videos
The provider may take photos and videos during the tours. These will be made available to participants where possible and may be used for advertising purposes on the website and social media (e.g. Instagram). By booking, participants agree to the use of these media as long as privacy is maintained and no offensive content is published.
8. withdrawal, cancellation and no-show
Cancellation costs:
Up to 30 days before departure: 10% of the tour price
Up to 15 days before departure: 30% of the tour price
Up to 3 days before the start of the tour: 50% of the tour price
From 2 days before departure or in the event of no-show: 100% of the tour price.
We recommend that you take out travel cancellation insurance.
9. force majeure
If the tour is significantly impeded or endangered due to force majeure (e.g. natural disasters, unforeseeable weather conditions), the provider reserves the right to cancel the tour or offer an alternative date or a replacement program. In the event of cancellation, the tour price will be refunded. There are no further claims.
10. final provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is the registered office of the provider. Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
